Employment-Based (EB) Immigration
The U.S. EB (Employment-Based) visa category includes several subcategories:
-
EB-1A Extraordinary Ability Immigration: No labor certification is required, avoiding a cumbersome, time-consuming, and expensive process. Suitable candidates include doctors, painters, architects, acupuncturists, educators, designers, dancers, actors, athletes, producers, etc. According to U.S. immigration law, applicants must provide at least three of the following ten pieces of evidence to demonstrate their top-level expertise in their field: 1. National or international award; 2. Invited membership in a professional association; 3. Publicly published material about you; 4. Judging the Work of Others; 5. Original contributions; 6. Scholarly articles; 7. Exhibitions or shows; 8. Leadership or critical role; 9. High salary; 10. Commercial success. When preparing documents, our firm will work with the applicant to uncover the core value, and a professional U.S. immigration lawyer will plan and draft a comprehensive solution to provide one-stop service.

EB-1C Immigration for Multinational Executives

EB-2 and EB-3 are both U.S. employment-based green card immigrant visas designed to address labor shortages in the United States. EB-2 is for applicants with a master's degree or higher, or a bachelor's degree plus five or more years of work experience in the relevant field; bachelor's degree applicants must apply for EB-3. EB-2 includes two subcategories: the National Interest Waiver (NIW) for specific reasons and the general EB-2 Labor Certification (PERM). EB-3 is for professional workers, skilled workers, and unskilled or underskilled workers; the requirements are relatively lower than EB-2, and the application process is similar.

EB-5 Immigrant Investor Program
EB-5 visa applicants have two investment pathways to invest in the United States:
Direct investment: Requires investors to find EB-5 investment projects themselves, such as establishing and directly managing new business entities. Suitable for investors who wish to manage their investments themselves and are focused on returns.
EB-5 Regional Center Investment: Regional centers, designated and managed by U.S. Citizenship and Immigration Services (USCIS), are private or public business entities that participate in increasing domestic capital, creating jobs, and enhancing regional creativity and economic growth. They are suitable for applicants who prioritize residency and do not wish to manage their investment businesses themselves. EB-5 projects require the creation of a new business entity and the provision of 10 full-time U.S. jobs.
The EB-5 program encompasses a wide range of sectors, including mixed-use retail, hospitality, stadiums, restaurants, agricultural development projects, electric vehicles, manufacturing, biotechnology and medical technology, casinos, entertainment venues, convention centers, and office buildings. Careful selection of EB-5 regional centers and projects is crucial, as investor permanent residency depends on whether the project meets legal requirements such as creating 10 full-time U.S. jobs.
